Legal & Policies
Last updated: February 9, 2026
These policies explain how SG Designs works: payment expectations, delivery, usage rights, and privacy. If anything here conflicts with your written invoice / statement of work, the invoice wins.
1) General Terms
- Who we are: SG Designs (the “Studio”) provides creative services and digital deliverables.
- Who you are: You (“Client”) purchase services for personal or business use.
- Age: You must be 18+ (or have a parent/guardian sign and pay on your behalf).
- Communication: Email is the official channel unless your invoice states otherwise.
Nothing on this page is a promise of specific outcomes (likes, sales, streams, reach, etc.).
2) Scope, Timelines, Revisions
- Scope: Your invoice / statement of work defines what’s included (deliverables, file types, revision rounds, intended use).
- Timelines: Time estimates begin once the retainer/deposit is paid and required materials are received.
- Revisions: Reasonable revisions are included as stated on your invoice. Extra rounds or major direction changes may be billed.
- Rush work: Rush timelines are optional and may include a rush fee.
3) Payments
- Booking: A non-refundable retainer/deposit is required to reserve time and begin work (unless your invoice says “pay in full”).
- Final delivery: Final high‑resolution / print‑ready files are delivered after the invoice is paid in full.
- Chargebacks: If a payment is disputed, delivery may pause until the dispute is resolved.
- Taxes/fees: If applicable, platform fees and taxes may be added through your payment processor.
Tip: paying via Stripe provides receipts and clear recordkeeping for both sides.
4) Cancellations & Refunds
- Retainers: Retainers/deposits are non-refundable once work begins, because that time is reserved and work starts immediately.
- Client cancellation: If you cancel mid‑project, you’re responsible for (a) the retainer and (b) any completed work up to the cancellation date.
- Studio cancellation: If SG Designs must cancel, you’ll receive a refund of any unearned fees.
- Digital deliverables: Completed custom digital deliverables are generally not refundable once delivered.
5) Delivery & Printing
- Delivery format: Deliverables are delivered digitally (download link, email, or client folder), unless otherwise stated.
- No print services: SG Designs does not provide printing. If you print files, you’re responsible for print vendor choice, settings, and results.
- Archiving: SG Designs may archive files for a limited time. Please back up your finals after delivery.
6) Usage Rights & Ownership (Plain‑Language)
Unless your invoice says “full rights transfer,” SG Designs keeps the underlying copyright to the artwork/music/design, and you receive a license to use the deliverables as described below.
- Personal projects (portraits, coloring sheets, personal artwork): You may use and print for personal use. You may not resell, redistribute, or upload to stock/print‑on‑demand sites without a commercial license.
- Business branding (logos/identity): After full payment, you receive an exclusive license to use the final approved logo/brand assets for your business. Working/source files (AI/PSD project files) are not included unless listed on the invoice.
- Album art: After full payment, you receive a license to use the final artwork for the release(s) and platforms listed on your invoice (e.g., single/EP/album, streaming, social promo). Expanded uses require an expanded license.
- Music / soundscapes: Site audio and SG Designs soundscapes are not licensed for reuse unless you purchase a separate license in writing.
Want commercial rights? No problem—SG Designs can quote a commercial license or transfer term based on your intended use.
7) Portfolio & Promotion
- Portfolio use: SG Designs may display work (finals and selected previews) for portfolio/marketing.
- Opt‑out: You can request portfolio opt‑out in writing before the project begins. Some projects (memorial/tribute) can be automatically treated as private on request.
- Credits: Please do not remove watermarks from preview images unless the final files are delivered without one.
8) Third‑Party IP, Reference Materials, and Client Responsibility
- Your materials: You confirm you own or have permission to use any photos, logos, brand assets, text, music, or references you provide.
- Characters/brands: Requests involving copyrighted characters, logos, or trademarked brands may be declined unless you can show permission/licensing.
- Likeness & consent: If your project includes another person’s likeness (especially minors), you confirm you have their consent (or are their parent/guardian).
- AI‑assisted tools: SG Designs may use digital tools, including AI‑assisted tools, as part of the creative process. Deliverables are still reviewed and refined for quality and intent.
9) Limitations (Reasonable, Studio‑Friendly)
- Cap: To the maximum extent allowed, SG Designs’ total liability is limited to the amount you paid for the specific service.
- No consequential damages: SG Designs isn’t responsible for indirect losses (lost profits, lost opportunities, platform takedowns, etc.).
- Good‑faith fix: If something is wrong due to an SG Designs mistake (wrong export, missing file), we’ll correct it.
7) Fan Content & Fandom Identities (Warhammer-Inspired)
SG Designs can create fan-made, original identity kits inspired by popular settings (for example: “Warhammer-inspired 40K”). These works are not official and SG Designs is not affiliated with Games Workshop.
What we will and won’t do
- We will: create original names, mottos, emblems, banners, color palettes, and lore inspired by your vibe.
- We won’t: copy official chapter symbols, faction logos, codex art, or any protected artwork you don’t own.
Client responsibility
- You confirm you have permission to use any reference images or materials you submit.
- If you want to use deliverables for a business/brand/merch, you must purchase the Commercial-use license add-on.
Note: This policy is for clarity and does not provide legal advice.
10) Privacy (Short + Clear)
- What we collect: Contact info, project details you submit, and payment details handled by our processor.
- How we use it: To communicate, deliver services, provide receipts, and keep business records.
- Payments: Payments are processed by Stripe. SG Designs does not store your full card number.
- Sharing: We don’t sell your information. We share it only with service providers needed to run the business (payment processing, email/hosting).
- Retention: We keep information only as long as needed for service delivery, backups, and reasonable business records.
